Privacy Policy and Personal Data Protection

Lush Era Limited (hereinafter referred to as “Lush Era”) develops and operates a medical collaboration network platform, the Dr.HereOnline Platform (hereinafter referred to as “DHO”) (Lush Era and DHO are collectively referred to as "We"). With respect to your (hereinafter referred to as the "user") privacy and compliance with the regulations pertinent to the Personal Data Protection Law, we are obligated to describe how Lush Era handles and protects your personal data that was provided to Lush Era through the use of the Website, DHO, and related applications and services based on this Privacy Policy and Personal Data Protection. Your use of our website, platform apps and services indicates your agreement to the terms of this policy. This policy is also part of the Terms of Use for the Lush Era Website.

1. Agreement on the Collection and Use of Personal Data

1) Purpose of collection

The purpose of our collection of your personal data is to provide you with services in our apps, DHO and other medical/healthcare/nursing services (if any), where we have to collect, handle (including but not limited to: recording, inputting, saving, editing, correcting, copying, retrieving, deleting, exporting, linking or internally transferring) or use your medical records and related data pursuant to the related regulations set forth in the Personal Data Protection Law.

2) Scope of personal data

  1. (1) Member Account: When you sign up and log in, you authorize experts or medical institutes to search or apply the data imported by a medical institute, consisting of the member information you provided such as: your name, gender, e-mail, phone number, country/region and other optional personal identity information (included but not limited to the Date of Birth, Identification Card No., Passport No., Mailing Address, Language, Education, Occupation and other means of contact).
  2. (2) Personal Health Information: You selectively choose to provide and save personal health information, including but not limited to: gender, date of birth, blood type, marital status, childbirth, habit of smoking, alcohol consumption, habit of chewing betel nut, habit of drinking coffee, daily working hours, daily sleeping hours, personal medical history, history of medications, history of taking healthcare products and history of family illness.
  3. (3) The information that is stored in the Intelligent Clinics, which have ongoing collaborations with DHO, includes (but is not limited to) the foregoing basic healthcare information, data of examination, and result of examination.
  4. (4) The health index and data that you have inputted manually, synchronized by the health monitoring devices, or provided by an authorized third party. All of the above may contain information of examination and other related data in the archives that you chose to upload from for online consultation.

3) Method of collecting personal data

In addition to those you fill out in person, we also may collect your personal data via other means as follows:

  1. (1) Traffic data: We collect messages that users provide on the website automatically, which includes but is not limited to: (a) IP address; (b) domain; (c) type of web browser; (d) operating system.
  2. (2) Cookies: Cookies are a kind of technology used by website servers to communicate with the client-end browser. It may save strings on the member's mobile phone/computer at random, and the user's browser provides this string to the website each time a user searches on the website. Cookies play a role in identifying a user as a unique user to the website and saves your password, saving you effort and time from needing to re-type your password during login. Additionally, we may use Cookies and other means to save and view data coming from your web browser. If you think it is not necessary to retain the Cookies on your mobile phone/computer, you may set the browser to "reject Cookies" prior to the website visit. However, please note that if no Cookies are allowed, you may not use some services and specified features on the mobile phone/computer.
  3. (3) Data on the handheld device: When you download, upload, install and use DHO on a handheld device or other wireless communication devices, we collect your information automatically, which includes but is not limited to mobile phone service providers, device model number, operating system, type of browser, and geographical location. The positioning service may be enabled or disabled via mobile devices at any time.

4) The period, area, subject for the use of personal data

  1. (1) Period of use: The use continues until the time when there is no longer a purpose for collection, or the due date of maintenance is reached pursuant to related laws and regulations or terms of a contract.
  2. (2) Area of use: It includes but is not limited to Taiwan, Vietnam, the British Virgin Islands and locations where all users and partner companies are situated.
  3. (3) Subject of use: Lush Era Limited and affiliates, DHO, 實用科技(股)公司, medical experts whom you have approved and authorized, Smart Clinics and members, information systems companies used for member data transfer authorized by Smart Clinics and other third party institutions in our delegation, legal competent authority or financial supervisory authority delegated by us.

5) Use of Personal Data

The form of use in automatic machines or otherwise non-automated ones includes but is not limited to written or electronic means, and potential international transfer scenarios.

  1. (1) Service provision: In accordance with your provided personal health data, diet preference, exercise habits and other information, we provide you our customized app service of Smart Clinics, online consultation service by medical experts, real-time care service, broadcasting service, Ms. Caring, medical/care/health management service (if any), referral service, reminder & tracking service and other user experiences, along with push related service messages.
  2. (2) Notice via messaging: We will notify you on the latest apps / product release of system updates and upcoming activities. If you join raffles or similar promotional events, we may also use the information you provided for participation in the related activities.
  3. (3) Analysis of use: We may collect or release news via an anonymous form or statistical form from time to time for industry analysis, research, traffic statistics and so on. We may even share the information with a third party for marketing purposes; however, we will not disclose your identity via the information.

6) The scope of using personal data

  1. (1) Service consultation: You can choose the medical expert consultation service applicable to you via DHO, and authorize your chosen medical expert to check your basic health reports and data in the examination report. You can also choose to add related feedback regarding the consultation service, upload health index lists, examination reports, or analytical results of your health condition as well. Even if you have authorized an expert to view your data, you can remove the authorization later.
  2. (2) Business information: If you are a healthcare provider or healthcare provider organization, you will likely set up the profile information about your healthcare services and consultations.
  3. (3) Operational data: In order to enhance the DHO platform usage experience, Lush Era may use cookies, server logs and other similar mechanisms to enable certain functionality, improve services and monitor service usage.

7) The rights of a user

You are entitled to ask or request for a preview of your personal data pursuant to the "Personal Data Protection Law." You can request for copying, updating, correcting, stopping the collection, handling and use of the data and requesting for deletion.

8) Links to other Websites

The website and apps of DHO contain links to third party websites and apps. We neither own, nor control these third party websites and apps. We are not liable for or bear any responsibility for any acts that have taken place on these third party websites and apps, and this Privacy Policy & Personal Data Protection Regulation does not apply to any of them. You should acknowledge the privacy policy and personal data protection regulation on these third party websites before you visit or provide personal data to them, and you should take measures to protect your privacy and personal data.

2. Use of Information

You can determine if you need to share your own personal health information with any third party at your own discretion. We are not responsible for personal data and privacy protection.

Payment Information: If you are a member, our secure third party payment providers will have access to your payment method and billing address details at the time of use of DHO and making online payments. These third party payment providers are bound by business contract obligations with regard to security and confidentiality. We do not store your credit card details nor that of any other online payment methods you may choose to use.

Contact Information: We will send you communications (email, mobile phone SMS and other notifications) based on your settings of notices, as part of essential functioning of services that you may find useful. At the time of registration, you will be required to verify your email address or mobile phone number. Your contact information may also be used for customer support services, should you choose to receive them. In addition, we may use your contact information to provide you with information about our products and services. If you decide at any time that you no longer wish to receive such information or communications from us, please follow the instructions provided to unsubscribe to any of our communication methods. Your contact information is not shared with any third-party service.

You are responsible for confidentiality of your password and account information, and only you are allowed to use it without exception. You take sole responsibility for all activities that occur in your account and you agree to notify us immediately of any unauthorized use of your account by a third party. We are in no way responsible for any loss that you may incur as a result of any third party's unauthorized use of your user account and password.

3. Disclosure of Information

We may disclose any information to government or law enforcement officials if we believe doing so is required to comply with law enforcement and legal processes, to prevent or stop any illegal, unethical, or legally actionable activity, or to protect your, our or other’s rights and safety.

If Lush Era becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, personal information will be transferred to the new entity for the continued performance of service.

We may disclose your personal information on your own request accompanied by your permission.

4. Transmission and Storage Security

All personal data is stored only in our servers on the highly secure Cloud Web Service platform. We take all necessary measures in providing secure transmission of your personal information before it is transferred across the Internet from your personal devices to our servers and in securing such personal information stored in our systems. However, you should be aware of the possible risks involved in transmitting information over the Internet as no data transmission can be guaranteed 100% security and free of risk from others that could find a way to thwart our security systems. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security and privacy of personal information you transmit to us, and you do so at your own risk.

5. Links to Other Websites

Our website may contain links to other websites. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personally identifiable information from you. Other sites follow different rules regarding the use or disclosure of the personally identifiable information you submit to them. We encourage you to read the personal data protection and privacy policies or statements of the other websites you visit.

6. Changes to this Policy

This Privacy Policy and Personal Data Protection Regulation may change from time to time with additions or updates to our provided application services. We will not reduce any of your rights that were granted by this Policy without obtaining your explicit approval. In the event of any changes in our Privacy Policy, the updated version will be posted on the Dr.HereOnline website and will take effect from the moment of posting. In the case of greater change made on this Policy, we will give you a clear notice, for example, any policy change for some services can be found on Ms. Caring Push.
